AVIA package terms

1. AVIA package characteristics

1.1. AVIA package is a type of international parcel that involves the acceptance of a parcel by “Georgian Post” LTD from a client in Georgia and its transportation and delivery to another country expeditiously, in the shortest possible time.

1.2. The list of countries where the AVIA package will be sent is given in Appendix No. 1.  It may be subject to updating (increase or decrease) due to force majeure or political or economic factors occurring in countries. Any changes in the list of countries will be published on the webpage of Georgian Post LTD www.gpost.ge.  

1.3. The content of an AVIA package may be both a document and an item.

1.4. The sender of an AVIA package may be an adult individual or legal entity.

1.5. AVIA packages can be sent both from the service center of "Georgian Post" LTD. and throughout Tbilisi by calling an AVIA courier to the desired address.

1.6. The AVIA packages are not insured.

1.7. The AVIA package to PO BOX address is not carried out.

1.8. The weight of an AVIA package should not exceed 30 kg. In addition, when calculating the weight of the parcel being sent, the largest weight between the volumetric and exact weights of the parcel is taken into account.

1.9. As a standard, an AVIA package not delivered to the addressee is not returned to the sender in Georgia and is subject to destruction after 21 (twenty-one) calendar days. In addition, the sender has the right, within the specified period, upon payment of an additional fee, to demand the return of the undelivered package to the addressee.

1.10. The sender has the opportunity, in case of payment of the established tariff, from the moment of transfer of the AVIA package to "Georgian Post" LTD until 17:00 of the same day to change the decision to send the AVIA package and request it back.

2.    AVIA package shipment                                                                                       

2.1. AVIA packages can be sent both from the service center of "Georgian Post" LTD and also throughout Tbilisi by calling an AVIA courier to the desired address. To contact the courier, use the call center (tel. +995 (32) 224 09 09) of "Georgian Post" LTD.

2.2. When sending an AVIA package by an individual, it is necessary to present an identification document of the sender, and in the case of sending a package through a representative, an identification document of the representative should also be presented. If the package is sent on behalf of a legal entity, the sender of the package must present the identification code and address of the legal entity along with his identity document.

2.3. The AVIA pakcage is registered in the electronic accounting system of "Georgian Post" LTD; it is assigned an identification code; and the package has a location tracking function.

2.4. The sender (the sender's representative) can only send an AVIA package to the countries declared by "Georgian Post" LTD at the time of sending the package.

2.5.  It is not permitted to put objects or items in an AVIA package that are prohibited by Georgian, transit, and/or addressee country legislation or international norms.

2.6.  The sender is responsible for properly packing the AVIA package. He/she must ensure that the package is packed in such a way that its contents and other goods transported with it are not damaged (including getting wet or spoiling) during transit. When packing an AVIA package, the sender must follow the recommendations of "Georgian Post" LTD.

2.7. In order to send an AVIA package, the sender must provide information about the sender and the addressee (name, surname, first name, personal number, identification number in the case of a legal entity, phone number, address (name of the country; postal code; settlement (city, township, village, etc.) street name; building and apartment number)), presentation of the list of items placed in the package and their value and filling in the appropriate form, in accordance with the instructions given in Appendix 2.

2.8. The AVIA package form must be filled out clearly, using Latin letters and Arabic numerals. All fields must be filled in correctly and completely.  Regardless of who physically fills out the form, the sender is responsible for the correctness of the information included in it, which the sender is obliged to provide. Before completing the sending procedure, the sender must familiarize himself/herself with the information entered in the form and sign the form as a confirmation that the data provided by him/her are correct and the message does not contain items prohibited by law.

2.9. In the event that the content of the AVIA package is the item, in addition to the form, the sender is also required to submit a completed and signed PROFORMA INVOICE in accordance with the instructions given in Appendix 3.

2.10.           The sender must be aware that if the information entered in the form and/or PRO FORM INVOICE about the contents of the package does not correspond to the items actually included in it, the entire package or individual items included in it may be confiscated and/or the sender or addressee fined. 

                                                                                                                                      

3.    Deadlines for receiving an AVIA package and delivering it to the addressee

3.1. The delivery period for an AVIA package to the addressee begins the next working day after the package is accepted by "Georgian Post" LTD, if acceptance occurs before 14:00 on a working day. AVIA packages received after this hour are deemed to be on the following business day.

3.2. The deadline for delivery of an AVIA package sent from Georgia to the addressee in the country of destination is 3-6 working days after its receipt by "Georgian Post" LTD.

                                                                                                                                                                         

4.    Prohibitions on the contents of an AVIA package

4.1. The following items are prohibited in the AVIA package:

4.1.1.  narcotics and psychotropic substances, as defined by the International Narcotics Control Committee, or other illegal substances prohibited in the country of destination;

4.1.2.  medical supplies;                                                                                                                              

4.1.3.  Items of an obscene or immoral nature;                                                                                       

4.1.4.  Counterfeit and pirated items;                                                                                                                                                                           

4.1.5.  any items the import or circulation of which is prohibited in the country of destination;                                                                                                                                      

4.1.6.  Items that, by their nature or packaging, may pose a danger to postal workers or the public, contaminate or damage other mail, postal equipment or the property of third parties.                                                                                                                                                                                                              

4.1.7.  Documents containing current and private correspondence sent by persons other than the sender, the addressee, or persons living with them.

4.1.8.  Documented anti-state propaganda against the destination country;

4.1.9.  Items classified as dangerous goods, including:

a) Inert explosive devices and ammunition for them, including inert grenades and shells and other similar items, as well as imitations of such devices and items;

b) radioactive substances;

c) infectious substances;

d) lithium elements and lithium batteries (both separately and included with the device);

e) Other items and substances that have been or may be assigned in the future the status of dangerous goods, in accordance with current legislation.

4.1.10.         live animals and animal parts;                                                                                                                                                                           

4.1.11.         parts of the human body;

4.1.12.         plants;                                             

4.1.13.         biological materials;                                                                                                                                                       

4.1.14.    Coins, banknotes, bonds, counterfeit money, change, cash or securities payable to the bearer, traveler's checks, platinum, gold, or silver (whether worked or unwrought), precious stones, ivory, jewelry, and other valuables;

4.1.15.    necessary equipment related to/for gambling;

4.1.16.    Religious materials, objects (objects of an anti-Islamic nature, religious statues, objects that are substitutes for the image of the Star of David);

4.1.17.    food products; cigarettes; medicines; any liquids, alcoholic beverages;

4.1.18.    cosmetic products, perfume;

4.1.19.    Daggers (including decorative purposes);

4.1.20.    Scissors, knife, pointed or sharp objects;

4.1.21.    items made from genuine leather;

4.1.22.    tobacco and products made from it;

4.1.23.    perishable products;

4.1.24.    works of art (sculpture, antiques);

4.1.25.    Counterfeit products/items;

4.1.26.    used goods in the direction of China;

4.1.27.    in the direction of European countries - passport or other identification document;

4.2. Packages containing prohibited items may not be sent to their destination, delivered to the addressee, or returned to the sender under any circumstances. If a prohibited item is discovered during transit of a shipment, it will be disposed of in accordance with the laws of the transit country, and if a prohibited item is found in the destination country, the competent authority of that country has the right to remove it from the package and destroy it.

                                                                                                                                             

5.    AVIA package packing recommendations

5.1.    Recommended to be used for packing packages:

·       for packages containing letters and documents, as well as original and special importance documents - soft postal envelopes with an air bubble insertion;

·       for packeges containing items - postal envelopes, soft, with an air bubble insertion; corrugated cardboard, plywood, wood, polymer, polystyrene foam - rigid boxes;          

5.2.    The sender is required to pack the package in accordance with its weight, shape, material, and nature of contents (liquid, fragile, solid, etc.), as well as the package's transportation duration.                                                                                                                                  

5.3.    The package must be packed in such a way that:

·       withstand long-distance transportation;

·       multiple reloading or processing, sorting;

·       changes in climate, temperature and atmospheric pressure;

·       Physical impact, pressure, vibration, shaking.

5.4.    The package is considered properly packed if it remains intact after a pressure of 80 kg and/or a free fall from a height of 80 cm onto a hard surface.

5.5.    When selecting packing material, the sender should consider the type and properties of the package's contents, weight, and shape. Packing material and proper packing of the contents must ensure the package's safety and integrity during transportation (for example, if a box is left empty, it may be crushed or compressed, while an overfilled box, on the contrary, may burst from an internal impact).

5.6.    If a package contains many products, each item must be individually packed before being securely placed in shipping packaging.

5.7. It is important that when shaking the parcel, the items placed in it do not move. To limit the movement of contents inside the package, it is recommended to use the following fillers:                                                                                                                                                   

·       cardboard;

·       newspaper;

·       Air bubble cellophane;

·       foam sponge;

·       penoplast;

·       kraft paper;

5.8.    The package must be firmly sealed on all sides to keep items from falling out during transportation, loading, and unloading. To do this, the sender must adhere to the following rules:                                                                                                                   

5.8.1.    While using an envelope, do not place so many documents or items in it that the self-adhesive part of the envelope cannot withstand and will open, or the envelope will tear anywhere else;

5.8.2.    While using a box or other type of packing, the package must be sealed by wrapping the entire package at least 5 cm with self-adhesive tape at least three times. 

5.9. Depending on the type of content, the following packaging rules must be followed:

5.9.1.    Fatty substances that dont turn into a liquid easily, such as ointments, semi-liquid soaps, resins, etc., should be placed in a hard box together with the primary packaging material (box, cloth bag, plastic container, etc.) to prevent the contents from leaking.                                                                                                                                  

5.9.2.    Dry paint powders, such as methylene blue and others, are only permitted in sealed metal boxes, which must be placed in rigid boxes filled with appropriate absorbent and protective material.

5.9.3.    Dry non-coloring powders must be placed in a solid container (box, bag) and then in strong boxes.                                                                                                               

5.9.4.    Items made of glass or other fragile or breakable items must be wrapped in bubble wrap, cloth, or another similar packing material and placed in a strong box filled with suitable protective material to prevent friction between the item and the box walls during transportation, and if the package contains several things, also friction between them.

 

6.    Additional service

6.1. Refusing to send an AVIA package

6.1.1.    The sender has the right to use the additional service “Refuse to send an AVIA package”.

6.1.2.    “Refuse to send an AVIA package” means the sender’s ability, based on payment of the established tariff, to refuse to send an AVIA package outside the country, which was transferred to "Georgian Post.".                                                                                  

6.1.3.       The service can be used if the AVIA parcel was transferred to “Georgian Post”:

· Until 14:00, and a statement of refusal to send is registered until 16:00 of the same day. 

·  After 14:00, and a statement of refusal to send is registered until 16:00 of the next working day.

6.1.4.       To use the service, the sender must contact the Georgian Post service center.

 

7.    Extent of liability and exceptional circumstances

7.1. The extent of liability "Georgian Post" LTD 

7.1.1.       “Georgian Post” LTD's extent of liability to the customer is determined by the direct material damage caused by its fault (intentional or negligence), but not exceeding the maximum limit defined by this document. However, material damage does not imply the customer's indirect losses, such as lost income.

7.1.2.       “Georgian Post” LLC assumes liability for damage which is caused by his fault of the AVIA package:

 

Ø by lost; 

Ø by complete or partial loss of content;

Ø by damage;                                                                                                                             

Ø by violation of the deadline for delivery to the addressee with more than 10 working days;                                                                                                                                                   

7.1.3.       An AVIA package is considered lost if the fact of loss is confirmed by a partner of "Georgian Post" LTD or the carrier company, or if information about the AVIA package could not be obtained within 60 (sixty) calendar days after it's shipment;

7.1.4.       An AVIA package is considered to have been received with a loss if such a fact is found before the AVIA package is transferred to the addressee or directly during its transfer;

7.1.5.       An AVIA package is considered received damaged only if the outer packaging of the package is damaged to such an extent that it could lead to damage to the contents of the package. In this case, the fact of such damage must be detected before the AVIA package is transferred to the addressee, or directly during its transfer;

 

7.2.    Circumstances under which "Georgian Post" LTD is released from liability

7.2.1.       "Georgian Post" LTD is released from liability if the AVIA package is delivered to the addressee by the postal administration of the country of destination, in accordance with the established rules.

7.2.2.       “Georgian Post” LTD is not responsible for any decisions of customs authorities regarding parcels subject to customs control.                                                                                   

7.2.3.       The liability of “Georgian Post” LTD is also excluded:                                                                                                 

a) In relation to AVIA packages, the reason for non-delivery to the addressee was incorrect (incomplete) information received from the sender.

b) In the event of circumstances caused by force majeure;

c) In cases where Georgian Post LTD cannot register packages due to the destruction of official documents as a result of force majeure;

d) If the loss of an AVIA package, complete or partial loss or damage to its contents is caused by the fault or negligence of the sender (including improper packaging), or by the properties of the contents;

e)  With regard to the AVIA package containing items prohibited for shipment;

fFor AVIA package, the sending of which is permitted only if there is a special condition (for example: if the shipment must be packaged in a certain way), in case of violation of such condition.

g) Based on current legislation in the event of seizure, destruction or confiscation of a package by government authorities;                                                                                            

h) If the sender acts dishonestly in order to receive compensation;

i) If the client does not contact “Georgian Post” LTD with a complaint within 2 (two) months from the day following the day the AVIA package was sent;

j) If the sender, when sending an AVIA package, requires a change in the original task (non-delivery of the message to the addressee, its return, redirection, etc.), which cannot be carried out by “Georgian Post” LTD.

k) If the AVIA package has no external damage and the difference in weight does not exceed:                                                                                                                                                      

Ø 20 grams for document;                                                                                       

Ø 500 grams for item.                                                                                                     

7.3.    Extent of Sender's Liability

7.3.1.       The sender is responsible for causing bodily injury to an employee of “Georgian Post” LTD, damage to someone else's parcel and/or damage to the property of “Georgian Post LTD, if the reason for the above arose through the fault of the sender:

a) By sending prohibited items;                                                                                                                              

b) By packing an AVIA package in violation of established rules.

7.3.2.       The sender's liability is not excluded even if “Georgian Post” receives an AVIA package for shipment that contains prohibited items or is packed in violation of established rules.  

7.4. Circumstances excluding the sender's liability

7.4.1.       If the sender complies with all the conditions established for sending an AVIA package, he/she is not responsible for damage caused by the fault of Georgian Post LTD during the processing and/or transportation of the package.

7.5.     Force majeure

7.5.1.       Force majeure is a circumstance that "Georgian Post" LTD cannot influence. However, based on the principles of reasonableness, it could not be expected that "Georgian Post" LTD, at the time of concluding the contract or at the time of non-contractual obligations, could take into account the mentioned circumstance, avoid it, or overcome both the specified impeding circumstance and its result.

7.5.2.       Force majeure circumstances will be considered for reasons independent of Georgia Post LLC: as a result of natural disasters, technical malfunctions, or obstacles; disasters; worsening weather leading to restrictions on movement; refusal of an international air transport company to transport postal items; war; strikes; changes in legislation; or any other event that Georgia Post cannot avoid or predict.

7.5.3.       If force majeure is temporary, the deadlines for fulfilling the obligation specified in this document are postponed for the period of time when force majeure prevented the fulfillment of the obligation.

                                                                                                                                                                                  

8.    Limitation of compensable damages                                                                                          

8.1. Georgian Post LTD compensates for damages in the following amount:

8.1.1.       In case of delay of delivery of an AVIA package to the addressee by more than 10 (ten) working days

a) If the document is sent by AVIA package - the difference between the cost of sending a paid AVIA package and the cost of sending an internationally registered small parcel (document) of the same weight by air, determined by “Georgian Post” LTD;

b) If the item is sent by AVIA package - the difference between the cost of sending a paid AVIA package and the cost of sending an internationally registered parcel of the same weight by air, determined by “Georgian Post” LTD;

8.1.2.       In case of loss of an AVIA package, its complete damage or loss of its contents, no more:

a) For documents - GEL, corresponding to 20 US dollars.

b) For items - GEL, corresponding to 50 US dollars.

8.1.3.       In case of partial damage and/or loss of the contents of an AVIA package - damage or loss within the cost, but not exceeding the maximum limit established for compensation of this type of AVIA package.

8.1.4.       In case of loss of an AVIA package, the sender has the right to demand a refund of the cost of sending the parcel.

8.1.5.       If the sender, in order to compensate for the damage, requires less compensation than specified in this article, “Georgian Post” LTD has the right to reimburse the smaller amount.

8.2. The sender will compensate for the damage in the following amount:

8.2.1.       In the event of an obligation to compensate for damage specified in clause 9.3., the damage to be compensated by the sender is determined by the amount that “Georgian Post” LTD will be liable to the victim.

 

9. Making a decision on compensation for damage

9.1. Submitting and consideration of a claim (complaint)

9.1.1.     The client has the right to file a reclamation with Georgian Post LTD:

Ø Regarding the search for a sent AVIA package, as well as the delivery status of the package;

Ø Due to a violation of the terms of service, including delivery deadlines for AVIA packages;

Ø In case of loss of the AVIA package, complete or partial damage and/or loss of its contents - compensation for damage.   

9.1.2.     The deadline for filing a reclamation is 2 (two) months from the date of shipment of the AVIA package.

9.1.3.     “Georgian Post” LTD has the right to leave a reclamation received after the specified period without consideration and to inform the author of the reclamation about this.

9.1.4.     The reclamation can be submitted in writing to the service center, or electronically by sending it to the email address of “Georgian Post” LTD: info@gpost.ge, or on the website of “Georgian Post” LTD - www.gpost.ge using digital services.

9.1.5.     The submitted reclamation must contain the following documents:

         a) Signed statement on reclamation;

     b) A copy of the applicant’s identity document, as well as a duly executed/certified copy of the power of attorney, if the applicant is the sender’s authorized representative; 

          c) Receipt confirming the cost of sending an AVIA package; 

d) In case of receipt of an AVIA package with damage or loss - a document drawn up in the prescribed manner, signed by the recipient of the postal item and an authorized representative of the postal administration of the destination country.

9.1.6.     The statement of reclamation must contain the following information:

a) The author of the reclamation, first and last name of an individual or name of a legal entity; his address and telephone number;

b)  Names and addresses of sender and addressee;

c) Data of the AVIA package, which is the basis of the reclamation (identification code; number of the postal service center from which the package was sent; date of sending).

d) The reclamation’s content.

e) The preferred form of receiving a response (oral, written - by mail or e-mail).

9.1.7.     If the information is not provided in full, "Georgian Post" LTD reserves the right not to consider the reclamation and to notify the author of the reclamation about it.

9.1.8.     The reclamation is submitted separately for each AVIA package.

9.1.9.     The reclamations are considered free of charge by Georgian Post LTD.

9.1.10.   In order to determine the amount of damage, "Georgian Post" LTD has the right to request at any time an expert assessment of the price of the item/items placed in the AVIA package, or documents confirming the value of such items.

9.1.11.  "Georgian Post" LTD considers a reclamation regarding an AVIA package within 10 (ten) working days after its receipt and informs the author of the complaint in the form specified by him/her. If it is not possible to give a comprehensive response within the specified period, the author of the reclamation will be notified within this period of time regarding the progress of the consideration of the reclamation, and the final response will be given within 2 (two) months after receipt of the reclamation.

9.1.12.  If, when considering a reclamation, the author of the reclamation is asked to provide additional documents to “Georgian Post” LTD, then the period from the moment of requesting such documents to their submission will be suspended.

9.2. Rule of compensation for damages

9.2.1.     If “Georgian Post” LTD makes a decision on compensation for damage, such compensation is carried out within 5 (five) working days after the decision is made

9.2.2.     Payment is made in lari according to the official exchange rate established on the day of payment.

9.2.3.     "Georgian Post" LTD generally pays compensation to the sender, who has the right to assign the right to receive compensation to the addressee if he notifies "Georgian Post" LTD in writing. Both the sender and the addressee have the right to assign the right to receive compensation to a third party if they notify Georgian Post LTD in writing.

9.2.4.     Reimbursement is made in the form of a non-cash payment by transferring the amount to a bank account.

9.2.5.     If, after payment of compensation, a lost AVIA package or part of it is found, "Georgian Post" LTD informs the person to whom compensation was made and explains that he/she has the right to receive the found parcel within one month in exchange for the compensation received. If the person to whom the reimbursement was made does not indicate his desire to return the found AVIA package within 10 (ten) working days from the date of receipt of the notification from “Georgian Post” LTD, it will be transferred to the property of “Georgian Post” LTD or another person, on whose expenses the reimbursement was issued.
